Candidate Consent

The explicit, informed permission obtained from a job applicant before collecting and processing their personal data for background verification purposes.

Candidate consent is the formal authorisation given by a job applicant permitting an employer and their BGV vendor to collect, process, and verify their personal data for the purpose of background verification. Under India's Digital Personal Data Protection Act 2023, obtaining valid consent is mandatory before initiating any background check.

Valid consent under the DPDP Act must be: (1) free — not coerced or conditional on employment; (2) specific — relating only to the stated BGV purpose; (3) informed — the candidate must understand what data is collected and how it's used; (4) unconditional — no bundled consents in general employment agreements; and (5) unambiguous — obtained through a positive affirmative action, not pre-ticked boxes.

The consent form must also inform the candidate of their rights under the DPDP Act: to access their data, correct inaccuracies, withdraw consent, and file a complaint with the Data Protection Board.

Yes, a candidate can refuse. However, employers are within their rights to make employment conditional on satisfactory background verification — and therefore to withdraw an offer if the candidate refuses to consent to legally required checks. The employer must not penalise the candidate for withdrawing consent after it's given, though this may affect their eligibility for the role.
